Article 20 of the GDPR also establishes a new right to data portability, which is closely linked to the right of access. The purpose of this new right is to empower the data subject, giving him greater control over the personal data that concern him.

 

The data subject has the right to receive the personal data concerning him / her and which he / she has provided to a controller in a structured format, in common use and automatic reading, and the right to transmit that data to another controller without the person responsible for whom the personal data was provided can prevent it.

 

WHAT TIME DOES IT TAKE TO RESPOND TO A PORTABILITY REQUEST?

Article 12 (3) requires the controller to provide “the holder with information on the measures taken ..., without undue delay and within one month of receiving the request. ».
